A California district lawyer declined to file expenses Tuesday in opposition to former heavyweight boxing champion Mike Tyson after he was recorded on video in a bodily altercation with another passenger on a JetBlue flight.

San Mateo County District Legal professional Steve Wagstaffe made the choice after having reviewed police stories and videos of the April 20 incident. Each the passenger, who has not been recognized, and Tyson requested that no costs be filed.

Cellphone video confirmed Tyson, 55, showing to attempt to punch someone who was pushing him away. Representatives for Tyson said the individual was harassing Tyson. The video did not present what happened before the altercation.

David Chesnoff, Richard Schonfeld and Martin Sabelli, attorneys for Tyson, responded to the decision to not file fees by thanking Wagstaffe, the San Mateo County sheriff and legislation enforcement agencies "for his or her cautious, diligent, and professional work."
